Terms and conditions
1. General provisions
1.1. These Terms of Use regulate the purchase of products through the online store and determine the rights and obligations of the Seller and the Buyer.
1.2. By making a purchase from the online store, the Buyer confirms that he has read the terms of use and agrees to them.
1.3. The products sold are live plants and other gardening goods.
2. Products and prices
2.1. All prices displayed in the online store are in euros and include VAT at 24%.
2.2. Living plants are natural products and their size, shape, number of flowers, color and appearance may differ from those shown in the picture.
2.3. The appearance of plants depends on the season, weather conditions and vegetation period.
3. Order processing and delivery
3.1. The order is considered confirmed after receipt of payment.
3.2. Shipping of live plants takes place during the period when weather conditions allow for the safe transport of the plants.
3.3. The seller is not responsible for delays caused by the transport company or force majeure.
4. BUYER'S RESPONSIBILITY FOR RECEIVING AND HANDLING LIVE MATERIAL
A living plant is a biological material whose viability directly depends on proper and timely handling.
The buyer undertakes:
4.1. Timely receipt of goods
Accept the order as soon as possible.
Check the condition of the shipment immediately upon receipt.
Ensure that plants ordered from the parcel machine are not left in the machine for an extended period of time (especially in hot or cold weather).
4.2. Immediate inspection
Check the condition of the plants immediately after receiving and opening the package.
Notify the Seller of any possible damage within 24 hours of receipt, including photos.
4.3. Proper handling after receipt
Remove the plants from the transport packaging immediately.
Provide plants with suitable growing conditions (light, temperature, humidity).
Plant the plants in a suitable location as soon as possible or provide temporary care (watering, shading, protection from frost).
4.4. Liability for improper maintenance
The seller is not responsible for damage or death of plants if:
the plant has been left in a parcel locker or post office for a long time;
the plant has been left unwatered;
the plant has been planted in an unsuitable location;
the plant has suffered frost or heat damage since delivery;
the plant is damaged by animals, pests or weather conditions.
From the moment the goods are delivered, the responsibility for the preservation of the living material passes to the Buyer.
5. Right of withdrawal
5.1. According to the Law of Obligations Act, the 14-day right of withdrawal does not extend to goods that spoil or age quickly, including live plants.
5.2. The deadline for submitting claims is 24 hours from the date of receipt of the goods.
6. Filing claims
6.1. The claim must be submitted in writing by e-mail.
6.2. The claim must include:
order number,
a description of the problem,
clear photos of the plants and packaging.
7. Responsibility
7.1. The seller is responsible for the proper packaging and delivery of the plants.
7.2. The seller is not responsible for the further growth, flowering or wintering of the plants, as this depends on the growing conditions and care.
8. Processing of personal data
8.1. Personal data is used only for order fulfillment and customer communication.
8.2. Data will not be transferred to third parties, except to the extent necessary for the provision of the transport service.
